1.1 This Privacy Policy explains how KH Technologies (Pty) Ltd (“KH Technologies”, “we”, “us”, or “our”) collects, uses, stores, and protects personal information when users access and use the Bucksshot mobile application and related services (“Platform”).

1.2 We are committed to processing personal information lawfully and in accordance with the Protection of Personal Information Act, 2013 (POPIA), and, where applicable, the General Data Protection Regulation (GDPR).

1.3 By using the Platform, you consent to the collection and processing of your personal information as described in this Privacy Policy.

2.1 For purposes of applicable data protection laws, KH Technologies (Pty) Ltd, registration number: 2026/137714/07, is the responsible party (or data controller) in respect of personal information processed through the Platform.

When you create a placement, we may process:

3.2.1 Your name as the hunter;

3.2.2 Species of animal hunted;

3.2.3 Horn length and weight (as provided by you);

3.2.4 Narrative or story relating to the hunt;

3.2.5 A generalised location description;

3.2.6 Photographs, media, and descriptive content;

3.2.7 Barcode-linked placement identifiers.

3.3 Payment Information:

Where paid placements are purchased:

3.3.1 Billing details;

3.3.2 Transaction information;

3.3.3 Limited payment verification data (processed via third-party payment processors);

3.3.4 We do not store full card details;

3.3.5 Technical and Usage Data;

3.3.6 Device type and operating system;

3.3.7 Log data and usage interactions;

3.3.8 App performance and diagnostic information.

4 Purpose of Processing

4.1 We process personal information for the following purposes:

4.1.1 To create and manage user accounts;

4.1.2 To enable creation and display of trophy placements;

4.1.3 To allocate and manage barcode identifiers for shared access;

4.1.4 To process payments for additional placements;

4.1.5 To respond to complaints, takedown requests, or disputes;

4.1.6 To maintain platform security and prevent unlawful use;

4.1.7 To comply with legal and regulatory obligations.

5 Lawful Basis for Processing

5.1 We process personal information on the following lawful bases:

5.1.1 Performance of a contract (providing the Platform and its functionality);

5.1.2 User consent (publication of name, story, and trophy details);

5.1.3 Compliance with legal obligations;

5.1.4 Legitimate interests in operating and securing the Platform.

5.2 Where consent is relied upon, users may withdraw consent subject to section 10 (Retention).

6 Public Display and Sharing of Information

6.1 By creating and publishing a trophy placement, you consent to the controlled display of the following information to authorised viewers:

6.1.1 Your name as the hunter;

6.1.2 Trophy details, including measurements;

6.1.3 Narrative and associated media;

6.1.4 A generalised location description.

6.2 Placements are not publicly searchable and are accessible only:

6.2.1 To you; and

6.2.2 To third parties with whom you voluntarily share the barcode identifier.

6.2.3 You acknowledge that shared placements may be accessed internationally where the barcode is shared.

7 Accuracy of User Provided Information

7.1 All trophy details, including species identification, measurements (horn/antler length and weight), narratives, and locations, are provided solely by users.

7.2 The Platform does not independently verify the accuracy of such information and relies on user-provided data.

8 Disclosure of Personal Information

8.1 We may disclose personal information:

8.1.1 To third-party payment processors to facilitate transactions;

8.1.2 To service providers who assist with hosting, storage, analytics, or app functionality;

8.1.3 Where required by law, court order, or regulatory authority;

8.1.4 To investigate complaints, unlawful conduct, or policy violations.

8.2 We do not sell personal information to third parties.

9 International Data Transfers

9.1 Where users share placements with individuals in other jurisdictions, personal information may be accessed outside South Africa.

9.2 Where required, we take reasonable steps to ensure that any international processing is subject to appropriate safeguards consistent with POPIA and, where applicable, GDPR.

10.1 We retain personal information only for as long as necessary to:

10.1.1 Provide the Platform services;

10.1.2 Maintain user accounts and placements;

10.1.3 Comply with legal and regulatory obligations;

10.1.4 Resolve disputes and enforce our Terms.

10.2 Users may request deletion of their account and associated placements, subject to any legal obligations requiring retention.

11.1 Subject to applicable law, users have the right to:

11.1.2 Request correction of inaccurate or incomplete data;

11.1.3 Request deletion or restriction of processing;

11.1.4 Object to processing on legitimate grounds;

13.1 The Platform is intended for use only by persons aged 18 years and older. We do not knowingly collect personal information from minors.

13.2 If we become aware that personal information of a minor has been collected, we will take steps to delete such information.
