1 Introduction

1.1 These Terms of Service (“Terms”) govern access to and use of the Bucksshot mobile application and related services (“Platform”), which is owned and operated by KH Technologies (Pty) Ltd (“KH Technologies”, “we”, “us”, or “our”).

1.2 The Platform enables users to create and publish digital placements of hunting trophies, each linked to a unique barcode identifier for controlled viewing and sharing with selected third parties.

1.3 By accessing or using the Platform, you agree to be bound by these Terms.

2 Nature of the Platform

2.1 The Platform operates solely as a neutral hosting service for user-generated content.

2.2 The Platform:

2.2.1 Does not verify the legality of any hunt;

2.2.2 Does not endorse or certify trophies, species, measurements, or hunting activities;

2.2.3 Does not guarantee the accuracy or authenticity of any user-provided information.

2.3 Users remain solely responsible for the legality, accuracy, and lawfulness of all content they upload.

3 Eligibility

3.1 You must be at least 18 years old and legally permitted to participate in hunting activities in your applicable jurisdiction to use the Platform.

3.2 By using the Platform, you warrant that:

3.2.1 You are legally entitled to possess and display the relevant hunting trophy; and

3.2.2 All hunts were conducted lawfully and in compliance with applicable conservation and hunting laws.

4 User Registration and Accounts

4.1 To create, publish, or manage trophy placements on the Platform, users are required to register an account.

4.2 During registration, users must provide accurate, current, and complete information and undertake to update such information promptly should it change.

4.3 Each account is personal to the registered user and may not be transferred, shared, or made available for use by any other person without the prior written consent of the Platform.

4.4 Users are responsible for maintaining the confidentiality and security of their login credentials and for all activities conducted under their account, whether authorised or unauthorised.

4.5 The Platform reserves the right to suspend, restrict, or terminate any account where:

4.5.1 false, inaccurate, or misleading registration information has been provided;

4.5.2 the account is used in breach of these Terms or applicable law; or

4.5.3 continued use poses legal, regulatory, or reputational risk to the Platform.

4.6 The Platform may, but is not obliged to, implement verification measures in respect of user identity or uploaded content. Any such verification shall not be construed as endorsement, certification, or confirmation of the legality or accuracy of any user, hunt, or trophy placement.

4.7 Users remain solely responsible for all content uploaded and all actions performed through their registered account.

5 Trophy Placements

5.1 Free Placements

5.1.1 Each registered user is entitled to publish up to four (4) trophy placements at no cost.

5.1.2 Each placement may include:
• The name of the hunter;

• Species of animal;

• Horn length or antler length, and weight (as provided by the user);

• A narrative or story relating to the hunt;

• A general location description;

• Photographs or media; and

• A title and unique barcode assigned by the Platform.

5.1.3 All measurements, including horn length, antler length, and weight, are provided solely by the user and are not independently verified by the Platform.

5.2 Paid Placements

5.2.1 Additional placements beyond the initial four (4) free placements will be subject to fees determined by the Platform from time to time. Applicable fees will be displayed in the Platform prior to purchase.

5.2.2 Payment is due prior to publication of a paid placement. The Platform reserves the right to amend pricing on reasonable notice.

6 Editing of Placements

6.1 Users may edit their trophy placements after publication.

6.2 Users remain solely responsible for the accuracy and legality of all edited content.

6.3 The Platform does not guarantee that shared placements will remain unchanged after initial publication, and third parties access shared placements at their own risk.

7 Barcode Functionality and Sharing

7.1 Each placement is assigned a unique barcode identifier which may be shared with selected third parties to access that placement.

7.2 Placements are not publicly searchable and are accessible only:

7.2.1 To the registered user; and

7.2.2 To persons with whom the barcode has been voluntarily shared.

7.2.3 The barcode:

• Serves solely as a digital reference to the placement;

• Does not verify or authenticate the legality, authenticity, or measurements of the hunt or trophy; and

• Must not be used for unlawful, misleading, or commercial resale purposes.

7.3 The Platform is not responsible for any third-party use or misuse of shared barcodes.

8 User Content & Warranties

8.1 You retain ownership of all content uploaded to the Platform.

8.2 You warrant that:

8.2.1 All information provided is true, accurate, and not misleading;

8.2.2 You have all rights and permissions to upload the content;

8.2.3 The hunt and possession of the trophy comply with all applicable hunting, conservation, and wildlife laws; and

8.2.4 The content does not infringe any intellectual property or personality rights.

9 Artificial Intelligence–Generated or Assisted Content

9.1 Users may utilise artificial intelligence tools to assist in drafting narratives or editing content, provided that all submitted information remains true, accurate, and not misleading.

9.2 Users are strictly prohibited from uploading or publishing:

9.2.1 AI-generated or synthetic images that falsely depict a trophy or hunt;

9.2.2 AI-altered measurements, including horn length, antler length, or weight;

9.2.3 Fabricated hunt narratives presented as factual events; or

9.2.4 Any AI-generated content that misrepresents the species, legality, authenticity, or circumstances of a hunt.

9.3 Users remain solely responsible for verifying the factual accuracy and authenticity of all content uploaded, regardless of whether artificial intelligence tools were used.

10 Prohibited Content

10.1 Users may not upload or share content that:

10.1.1 Relates to unlawful hunting activities;

10.1.2 Depicts protected or endangered species without lawful authorisation;

10.1.3 Is false, misleading, defamatory, or abusive;

10.1.4 Contains graphic or disturbing material unsuitable for general viewing;

10.1.5 Infringes intellectual property or privacy rights of any person.

10.2 The Platform reserves the right to remove any content that violates these Terms.

11 Takedown & Complaints

11.1 Any person may submit a complaint or takedown request regarding content believed to be unlawful, inaccurate, or infringing.

11.2 Upon receipt of a valid complaint, the Platform may:

11.2.1 Temporarily suspend or remove the content;

11.2.2 Request supporting documentation from the uploading user; and

11.2.3 Make a final determination in its sole discretion.

11.3 The Platform is not obliged to adjudicate disputes between users.

12 Payments, Refunds & Cancellations

12.1 Where fees are charged for additional placements:

12.1.1 Payment is due prior to publication;

12.1.2 Fees are non-refundable once a placement is published, except where required by law;

12.1.3 Refunds may be considered in cases of duplicate charges, technical publication failure, or other exceptional circumstances attributable to the Platform.

12.2 Where a refund is granted, it will be processed within 30 days of the purchase date.

12.3 Nothing in this clause limits any rights afforded to consumers under applicable consumer protection laws.

13 Privacy & Data Protection

13.1 The Platform processes personal information in accordance with its Privacy Policy and applicable data protection laws, including the Protection of Personal Information Act, 2013 (POPIA) and, where applicable, the General Data Protection Regulation (GDPR).

13.2 By publishing a placement, you consent to the public display to authorised viewers of:

13.2.1 Your name;

13.2.2 Trophy details and measurements;

13.2.3 Associated narrative and media; and

13.2.4 A generalised location description.

13.3 You acknowledge that shared placements may be accessed internationally where a barcode is shared.

14 Intellectual Property

14.1 Ownership of Platform Intellectual Property:

14.1.1 All intellectual property rights in and to the Platform, including but not limited to the software, application architecture, database structure, placement workflow, barcode allocation system, design, layout, functionality, and underlying technology, are owned by or licensed to KH Technologies (Pty) Ltd.

14.1.2 These rights include all copyright, trade mark, database, and other proprietary rights, whether registered or unregistered.

14.2 Independent Development:

14.2.1 The Platform and its features have been independently developed and implemented by KH Technologies. Nothing in these Terms shall be construed as implying any affiliation with, endorsement by, or association with any other application or service used to document or publish hunting trophies.

14.3 User Content Ownership:

14.3.1 Users retain ownership of all content they upload to the Platform, including photographs, narratives, and descriptive information relating to their trophies.

14.3.2 By uploading content, users grant KH Technologies a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute such content solely for purposes of operating and improving the Platform.

14.4 No Transfer of Platform Rights:

14.4.1 Nothing in these Terms grants users any ownership rights in the Platform or its proprietary systems. Users receive a limited, non-transferable right to access and use the Platform in accordance with these Terms.

14.5 Restrictions on Copying and Competitive Use:

14.5.1 Users may not, without prior written consent of LH Technologies:

• Copy, reproduce, or replicate the Platform’s structure, functionality, or workflow;

• Extract or scrape data from the Platform for commercial purposes;

• Reverse engineer or attempt to derive the source code or system architecture; or

• Use the Platform or its data to develop, train, or support any competing application or service.

14.6 Trade Marks and Branding:

14.6.1 All names, logos, and branding associated with the Platform are the property of KH Technologies or its licensors. Users may not use any trade mark, logo, or branding of the Platform without prior written consent.

14.7 Reservation of Rights:

14.7.1 All rights not expressly granted to users in these Terms are reserved by KH Technologies.

15 Disclaimer Regarding Legality of Hunts

15.1 The Platform does not investigate, verify, or certify the legality of any hunting activity, trophy, species identification, or measurement displayed.

15.2 Users remain solely responsible for compliance with all applicable wildlife, conservation, and hunting laws in their respective jurisdictions.

16 Limitation of Liability

16.1 To the fullest extent permitted by law, the Platform shall not be liable for:

16.1.1 Any unlawful, inaccurate, or misleading user content;

16.1.2 Any disputes regarding species identification or trophy measurements;

16.1.3 Any third-party reliance on content or barcode-linked placements;

16.1.4 Any regulatory or legal consequences arising from a user’s hunting activities; or

16.1.5 Any indirect, incidental, or consequential damages.

17 Suspension & Termination

17.1 The Platform may suspend or terminate accounts that:

17.1.1 Breach these Terms;

17.1.2 Upload unlawful or prohibited content; or

17.1.3 Engage in conduct that poses legal or reputational risk to the Platform.

18 Governing Law

18.1 These Terms are governed by the laws of the Republic of South Africa.

18.2 Any disputes shall be subject to the jurisdiction of the competent South African courts.

19 Amendments

19.1 The Platform may update these Terms from time to time. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

20 Contact

20.1 All legal notices, complaints, and takedown requests must be submitted via the in-app contact channel or directed to KH Technologies (Pty) Ltd at the contact details published on the Platform.
