Species Legality & Hunting Compliance Disclaimer BUCKSSHOT

1. Purpose

1.1 This Species Legality & Hunting Compliance Disclaimer (“Disclaimer”) clarifies the responsibilities of users regarding compliance with applicable hunting, conservation, and wildlife laws when using the Bucksshot mobile application (“Platform”), which is owned and operated by KH Technologies (Pty) Ltd (“KH Technologies”, “we”, “us”, or “our”).

1.2 This Disclaimer must be read together with the Terms of Service, Acceptable Use & Content Policy, and Takedown & Complaints Policy.

2. User Responsibility for Legal Compliance

2.1 Users are solely responsible for ensuring that all hunts, trophies, species representations, and related content published on the Platform comply with all applicable laws and regulations in the jurisdiction where the hunt occurred and where the trophy is possessed.

2.2 This includes, but is not limited to:

• 2.2.1 Hunting permits and licences;

• 2.2.2 Conservation and biodiversity legislation;

• 2.2.3 Protected or endangered species regulations; and

• 2.2.4 Cross-border transport and ownership requirements.
  

3. No Verification or Certification by KH Technologies

3.1 KH Technologies does not:

• 3.1.1 Verify the legality of any hunt;

• 3.1.2 Confirm the authenticity of any trophy;

• 3.1.3 Certify species identification;

• 3.1.4 Validate measurements, including horn length, antler length, or weight; or

• 3.1.5 Confirm compliance with any conservation or wildlife legislation.
  

3.2 All information displayed on the Platform is provided solely by users and is not independently investigated or endorsed by KH Technologies.

4. Protected or Restricted Species

4.1 Users must ensure that any content relating to protected, endangered, or otherwise regulated species is uploaded only where lawful authorisation has been obtained.

4.2 KH Technologies reserves the right to remove or restrict access to any content where:

• 4.2.1 There are reasonable concerns regarding legality;

• 4.2.2 Supporting documentation cannot be provided upon request; or

• 4.2.3 Continued publication poses legal or regulatory risk.
  

5. Jurisdictional Variations in Hunting Laws

5.1 Users acknowledge that hunting laws and conservation regulations vary between jurisdictions.

5.2 Content that is lawful in one jurisdiction may be unlawful in another.

5.3 Users are responsible for ensuring compliance with all applicable laws in the relevant jurisdiction(s).

6. No Facilitation of Hunting Activities

6.1 The Platform is intended solely as a digital record and sharing tool for user-generated trophy placements.

6.2 The Platform does not:

• 6.2.1 Arrange hunts;

• 6.2.2 Facilitate hunting services;

• 6.2.3 Broker hunting opportunities; or

• 6.2.4 Participate in the trade or sale of wildlife or wildlife products.
  

7. Reporting of Suspected Unlawful Content

7.1 Any person who believes that a trophy placement relates to unlawful hunting or possession may report the content in accordance with the Takedown & Complaints Policy.

7.2 KH Technologies may request supporting documentation from the user and may remove or restrict access to content pending review.

8. Limitation of Liability

8.1 To the fullest extent permitted by law, KH Technologies shall not be liable for:

• 8.1.1 Any unlawful hunting activity represented on the Platform;

• 8.1.2 Any inaccuracies in species identification or trophy measurements;

• 8.1.3 Any reliance by third parties on user-provided content; or

• 8.1.4 Any regulatory consequences arising from a user’s hunting activities or possession of trophies.
  

9. Cooperation with Authorities

9.1 Where required by law, KH Technologies may cooperate with lawful requests from regulatory authorities, conservation bodies, or law enforcement agencies relating to content on the Platform.

10. Amendments

10.1 KH Technologies may amend this Disclaimer from time to time to reflect changes in legal requirements or Platform functionality. Continued use of the Platform after amendments constitutes acceptance of the revised Disclaimer.
